Where you propose to make 20 or more staff redundant in a 30 day period or 90 or more staff redundant in a 100 day period Collective consultation including notification of the DTI is required.
The legislation is complex and the penalties for breaches of the legislation harsh. To complicate matters further the Statutory Disciplinary and Dismissal Procedures now cover redundancies where fewer than 20 staff are affected. Failure to follow those procedures can result in a finding of automatically unfair dismissal.
